The Arkansas Supreme Court has denied a request to reconsider its opinion upholding a local judge’s ruling that three members of the Eureka Springs City Advertising and Promotion Commission were not appointed illegally.
In a majority opinion issued March 10, the state’s high court upheld the ruling by Carroll County Circuit Judge Scott Jackson that commissioner Carol Wright and now-former commissioners Melissa Greene and Harry Meyer were legally appointed to the CAPC.
Tim Parker, an attorney representing several plaintiffs in a wide-ranging lawsuit against the city, several current and former commissioners and other city officials including Mayor Butch Berry, had petitioned the state Supreme Court for a rehearing on an appeal of Jackson’s ruling, but the court denied that petition in an order issued Thursday, April 28.
